Amid twists and turns, US appeals court temporarily reinstates Trump tariffs

The latest turn in US President Donald Trump’s tariffs drama on Thursday saw a federal appeals court reinstating his tariffs plan. The order came after the Court of International Trade had on Wednesday ruled that the US president did not have the authority to slap nearly every country with tariffs.

The Court of Appeals accepted the White House’s appeal to the earlier ruling that had ordered the tariffs to be halted within 10 days. The Court of Appeals instead said that the tariff plan could remain in place, while the court “considers the motions paper”.
While Mr Trump is yet to comment directly on the trade court ruling or the appeals court ruling, one of his top advisors, Peter Navarro, took to the White House driveway to say the administration was prepared to take the case “up the chain of command” after the appeals court, if necessary. This would mean asking the Supreme Court to rule on the constitutionality of its tariff plan.
The trade court had ruled that Mr Trump had unlawfully invoked the 1977 International Emergency Economic Powers Act (IEEPA) to declare a national emergency and impose tariffs on nearly all US trading partners. A three-judge panel had concluded that the IEEPA, designed for urgent national threats, did not justify sweeping tariffs in response to long-standing trade deficits.
